GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

Riad Mazal Mogador

These General Terms and Conditions of Sale (GTCS) govern all reservations made directly with Riad Mazal Mogador, whether through its website, by email, telephone, WhatsApp, or any other direct booking channel.

Riad Mazal Mogador is a charming guesthouse where comfort, tranquillity, and respect for the property are fundamental values. These General Terms and Conditions are intended to ensure a pleasant and harmonious experience for all our guests.

Any reservation constitutes full and unconditional acceptance of these General Terms and Conditions.

1. Reservations

A reservation shall only be considered confirmed upon:

written confirmation from Riad Mazal Mogador; and
payment of a deposit equal to 50% of the total amount of the stay.

The remaining balance must be paid no later than check-in, unless otherwise agreed in writing.

The Riad reserves the right to cancel any reservation if the required deposit has not been received within the deadline specified in the booking confirmation.

The guest authorizes the Riad to charge the credit or debit card provided at the time of booking for any outstanding amounts, including but not limited to:

unpaid balances;
departure without payment;
damage caused to the Riad;
cancellation or no-show charges in accordance with these Terms and Conditions.

2. Rates

Rates are quoted in Euros (€) or Moroccan Dirhams (MAD), depending on the booking channel.

Unless otherwise stated, rates include:

accommodation;
breakfast;
Wi-Fi access.

The Moroccan tourist tax is mandatory and charged in addition to the room rate in accordance with applicable Moroccan regulations.

The Riad reserves the right to modify its rates at any time. However, confirmed reservations will always be charged at the rate applicable at the time the reservation was confirmed.

3. Cancellation Policy

Cancellation by the Guest

All cancellations must be communicated in writing (by email or WhatsApp).

More than 7 days before the scheduled arrival date: full refund of the deposit.
Less than 7 days before arrival: the deposit is non-refundable.
In the event of a no-show, the full amount of the stay shall be charged.

Early Departure

Any stay that has commenced shall be deemed fully consumed.

In the event of an early departure or a reduction in the length of stay after arrival, no refund, whether partial or full, shall be granted.

4. Booking Modifications

Any request to modify a reservation is subject to availability.

The Riad cannot guarantee the possibility of changing booking dates, services, or room category.

Any modification may result in a revision of the original rate.

5. Check-in and Check-out

Rooms are available as follows:

Check-in: from 3:00 PM
Check-out: until 11:00 AM

Late arrivals must be communicated in advance.

For arrivals after 10:00 PM without prior notice, the Riad cannot guarantee that the reservation will be maintained.

6. Room Occupancy

Each room may only accommodate the maximum number of guests corresponding to its stated capacity.

Any undeclared additional guest may be refused access or be subject to additional charges.

7. Children

Children are welcome.

Parents or accompanying adults remain fully responsible for supervising children, ensuring their safety, and covering any damage they may cause.

Children must always be accompanied by an adult when using the terraces, staircases, swimming pool (where applicable), and any other facilities within the Riad.

8. Pets

Pets are not permitted unless prior written approval has been obtained from the Riad.

9. Non-Smoking Rooms

All guest rooms and indoor areas of the Riad are strictly non-smoking.

Smoking is permitted only in the designated outdoor areas.

Failure to comply with this policy may result in additional charges to cover deep cleaning, deodorizing, or temporary loss of use of the room.

10. Respect for the Property

In order to preserve the peaceful atmosphere of the Riad, guests agree to respect the comfort and tranquillity of other guests.

Noise must be kept to a minimum, particularly between 10:00 PM and 8:00 AM.

The Riad reserves the right to terminate the stay of any guest whose behaviour is considered disruptive or contrary to safety, tranquillity, or respect for staff, other guests, or the property, without any obligation to provide a refund.

11. Damage

Guests are responsible for any damage, loss, or deterioration caused during their stay, whether by themselves, accompanying persons, or children under their supervision.

The Riad reserves the right to charge for:

repair costs;
replacement of damaged property;
restoration costs;
any loss of revenue resulting from the temporary unavailability of a room.

12. Services Provided by Third-Party Partners

The Riad may offer guests various services provided by independent third-party partners, including but not limited to:

airport transfers;
excursions;
sporting activities;
surfing;
kitesurfing;
spa treatments;
wellness treatments;
other tourist activities.

The Riad acts solely as an intermediary.

These services are provided under the sole responsibility of the respective service providers.

Accordingly, the Riad shall not be held liable for:

the performance of such services;
cancellations;
delays;
accidents;
injuries;
personal injury or property damage;
any incident occurring during these activities.

Guests acknowledge that they participate in these activities entirely at their own risk and confirm that they are physically fit to do so.

The terms and conditions of the relevant service provider shall apply.

13. Liability

The Riad shall not be held liable for:

loss, theft, or damage to personal belongings;
improper use of the facilities;
damage resulting from negligent or unsafe behaviour by the guest.

Safes provided in certain rooms are intended for the storage of valuables.

The Riad accepts no responsibility for valuables left unattended in guest rooms or common areas.

14. Lost Property

Lost property will be kept for a maximum period of three (3) months.

Upon request, forgotten items may be returned to the guest at their own expense and risk.

15. Force Majeure

The Riad shall not be held liable for any total or partial failure to perform its obligations due to force majeure or events beyond its reasonable control, including but not limited to:

natural disasters;
fire;
flooding;
earthquakes;
pandemics;
governmental or administrative decisions;
labour disputes;
widespread interruptions to water, electricity, or telecommunications;
any other unforeseeable and unavoidable event.

16. Personal Data

Personal information collected during the booking process is used solely for the management of the guest's stay and in accordance with applicable data protection laws.

Such information will not be sold or disclosed to third parties except where necessary for the provision of booked services or where required by law.

Guests may exercise their rights of access, rectification, or deletion of their personal data in accordance with applicable legislation.

17. Photography

Guests are welcome to take photographs for strictly personal use.

Any commercial, professional, or promotional use of photographs featuring the Riad requires the prior written authorization of the Management.

18. Governing Law

These General Terms and Conditions shall be governed by the laws of the Kingdom of Morocco.

Any dispute relating to their interpretation or performance shall fall under the exclusive jurisdiction of the Moroccan courts, unless otherwise required by mandatory applicable law.

19. Language

These General Terms and Conditions are available in both French and English.

In the event of any discrepancy between the different language versions, the French version shall prevail.

Acceptance

By confirming a reservation, the guest acknowledges having read these General Terms and Conditions of Sale and agrees to be bound by them without reservation.
